Our Publications

a. You are solely responsible for any and all content you provide to us for publishing, including any and all risks related to its publication, including someone else's reliance on its accuracy and any claims relating to intellectual property or other legal rights.

b. You acknowledge and agree that any content you provide to us for publishing will not violate the intellectual property or other rights of the author or any other third party and that you have the necessary written consent/permission from the author for any content you provide us for publishing.

c. You further acknowledge and agree that all content provided to us for publishing is original and free from plagiarism. We do not review content for plagiarism and therefore will not be held liable if any content posted is in violation of any third party's rights. We reserve the right to pursue legal action against you if you provide us the plagiarised or infringing content for publishing.

d. Spark Grid makes no claim to the rights in copyright of any content provided by you.

e. We do not allow the infringement of copyright while publishing books through us, and will remove any content that we deem to be in infringement of a third-party's rights.

f. In order to facilitate the online sale of the books published through us, you hereby grant Spark Grid a non-exclusive license to make the books available on amazon.in and/or flipkart.com.

a. We do not own your content and make no claims to the rights in copyright therein.

b. Spark Grid is committed to respecting intellectual property rights.

c. If it is brought to our notice that any content provided to us for publishing is infringing on any copyrights, we will unpublish the book with immediate effect.

d. We reserve the right to determine if any content on the platform is in violation of copyright or any other violation of these Terms.

a. By providing us the contents of the books for publishing, you represent and warrant that:

i. You accept and agree to abide by all of the Terms contained herein and you represent and warrant that you are not, and will not be, under any disability, or other restriction, which prevents your ability to enter into, perform in accordance thereof, and comply with all of these Terms and our applicable policies and guidelines.

ii. All contents provided by you for publishing will be considered non-confidential and non-proprietary, do not infringe on the contractual, intellectual property, privacy, publicity, or other rights of any third party, you have all necessary licenses, rights, consents, and permissions to get the books published through us.

a. The books and contents are published as provided. We do not make any representations or warranties regarding the accuracy or validity of any content provided to us. While we will make reasonable efforts to ensure the accuracy of any content published through us, we shall not be held liable for any discrepancies in this regard.

b. We do not monitor all of the content provided to us for publishing. Therefore, nothing published by us implies that we approve, endorse, or are aware of such content. If you come across offensive, objectionable, obscene, or illegal content published by us, please let us know and we will review it before taking a final decision.

c. We do not guarantee that the contents of the book published through us will always be accessible and available to you. You are responsible for backing up and storing any information or content that you may wish to, subject to compliance with these Terms.

d. If any content published through us or other intellectual property is infringed upon by a third party, we are under no obligation to pursue legal action on your behalf. Notwithstanding the foregoing, if an intellectual property infringement occurs while publishing the book through us, we will remove such infringing material after investigation in accordance with these Terms.

e. To the fullest extent possible under applicable law, we disclaim all warranties, whether express or implied, including without limitation, warranties of fitness, merchantability, or for a particular purpose, in respect of the books published through us.

a. You shall defend and hold harmless Spark Grid and any of its affiliates from any and all liabilities, costs, claims, damages, losses, or injuries arising out of or in connection with the content provided by you for the publishing purpose.

b. In such jurisdictions, you shall indemnify Spark Grid and its affiliates to the fullest extent possible under applicable law. Some jurisdictions do not provide for the exclusion of implied warranties on applicable statutory rights; or limitations on a contracting party's liability with regards to damages or death caused due to its negligence or intentional misconduct.

a. Notwithstanding anything to the contrary contained herein, to the fullest extent permissible by applicable law, Spark Grid shall not be liable to you for any direct, indirect, special, incidental, consequential, exemplary, extra-contractual, or punitive damages of any kind whatsoever, which are in any way related to the publishing of the books through us or these Terms, whether or not Spark Grid has been advised of the possibility or probability of such damages, and even if the remedies otherwise available fail of their essential purposes.

b. In all cases, Spark Grid will not be liable for any loss or damage that is not reasonably foreseeable.

c. Your sole and exclusive remedy for dissatisfaction with the publishing book through us is to get the book unpublished through us.

a. There are fees applicable in respect of publishing services available through us. These charges are provided in Schedule-B of this agreement.

b. By selecting a particular service, you agree to pay Spark Grid the applicable one-time publishing fee. Payments will be charged on the day you provide us the content for publishing.

c. Fees are not refundable once the Service has commenced.

a. We allow cancellations of services only if the applicable service has not commenced, for a full refund, if applicable.

b. All publishing orders are processed within two weeks and the free author copies are delivered in another two weeks. The times mentioned above are approximate and delivery is subject to the courier partners and local conditions at the delivery location.

c. We currently do not ship outside India.

a. Amendments – The conditions set forth in these Terms may change from time to time. Your continued availing of publishing services through us after any change means that you agree with, and consent to be bound by, the new Terms.

b. Waiver – In the event that Spark Grid chooses not to enforce a particular right or remedy under these Terms, it does not mean that we have waived those rights. No waiver shall be valid unless specifically consented to by Spark Grid in writing.

c. Severability – If any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

d. Independent Parties – Nothing contained in these Terms shall be construed as creating any agency, partnership, affiliation, joint venture or other form of joint enterprise between you and Spark Grid.

e. Interpretation – The headings in these Terms are for convenience only and shall not be used in their interpretation.

f. Governing Law and Jurisdiction – These Terms shall be construed in accordance with and governed by the laws of the Republic of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Kanpur Nagar, India.

g. Assignment – The rights granted by Spark Grid to you under these Terms are exclusive to you and cannot be sublicensed, transferred, or assigned to any third party.

h. Agreement – These Terms constitute the entire agreement between Spark Grid and you regarding availing of publishing services through us.
